Privacy notice for the Thomas photo competition on Instagram

During the photo competition organised on our Thomas Porzellan Instagram page from 9 September 2020 to 20 December 2020, we will process your personal data (any information relating to an identified or identifiable natural person), provided that we are permitted to do so by law or we have your consent to do so. In the following, we provide you with detailed information concerning the extent, purposes, duration and legal bases for processing your personal data as well as your rights as a data subject.

C. General information about data processing

During our contest, we process the following personal data which we request directly from you:

  • First name, last name;
  • Instagram name;
  • Contest post/image post
  • Mailing address.

If you upload images during the competition that contain your own image or the images of other individuals whose consent you obtained in advance with a view to the intended purpose, we will also process this personal data.

D. Scope and purposes of the data processing

We process your data to conduct the photo competition, which means specifically to register you as a participant so that you will be considered for the award and so that we may notify you if you win. If you are one of the winners, we will publish this on our Instagram page and send your prize to the indicated mailing address. On our Instagram page, we may also publish personal data contained in the images you upload as part of an Instagram story.

  • Facebook Ireland Limited as host and provider of the Instagram platform and its affiliated company Facebook Inc., which is based in the US;

F. Duration of storage

We will store your data until the photo competition has been fully settled and then erase the data within 30 days after the end of the photo competition. This excludes the fact of your winning and submitted images which remain published on our Instagram page for an undefined period of time.

G. Legal bases for processing

The processing of personal images in uploaded photos takes place based on the consent that you grant us by participating in the photo competition. The processing of all other personal data to conduct the photo competition takes place based on our legitimate interest in organising the photo competition. We assume that our legitimate interest is not overridden by any of your interests or fundamental rights and freedoms (Article 6, Paragraph 1f GDPR). On request, we would be happy to provide you with more information about how we have weighed up these interests.

H. Right to withdraw consent

You may withdraw your consent to the processing of personal images in uploaded photos at any time with future effect by contacting us using the contact details indicated in A above. However, you will no longer be able to participate in the photo competition.

I. Right to object

You have the right to object to the processing of your data to conduct the photo competition at any time on grounds relating to your particular situation. If you exercise this right, we will no longer process this data for these purposes and your participation in the photo competition will be excluded, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or unless the processing is being used to establish, exercise or defend legal claims. You can exercise your right to object by contacting us using the contact details provided under A above.


J. Your additional rights as a data subject

In addition to the right to object, you have the following rights relating to your personal data:
